October 2024 - Over the past 3 years Chief Connell has been keeping busy, founding and expanding a sister-company called Advanced Training Products (ATP).
What ATP Does: Provides Workplace Impairment Recognition & Evaluation (WIRE) training as required for employers by the 2021 NJ CREAMM Act.
The is a 2 hour, online, on-demand training for employers on how to identify and document reasonable suspicion of employees’ workplace impairment. Successful completion of the training unlocks FREE access to the WIRED Algorithm, which is a web-based tool employers can use to document an assessment and which leverages a proprietary Closed-Loop AI engine to produce the Reasonable Suspicion Observed Behavior Report which is specified by the NJ Cannabis Regulatory Commission.
This training equips employers and supervisors with the skills to:
Formulate and document reasonable suspicion that an employee is impaired during work hours.
Meet the requirements set forth by the 2021 CREAMM Act regarding how to handle the employment aspects of legal cannabis use in NJ.
Protect their business and employees by ensuring they can address suspected impairment situations appropriately.
Why Is This A Problem? Because cannabis is metabolized differently than alcohol, a person will test positive long after the impairing effects have worn off, which challenges employers’ duties to maintain a safe workplace. Certain states like New Jersey have taken steps to address this disconnect, requiring point-in-time reasonable suspicion be documented by someone who is trained in how to identify impairment in order to support a valid drug test. The reality is that most states and employers don’t know how to handle suspected impairment in their workplace and their fear of litigation drives them to ignore the issue and hope there are no accidents or injuries. Except the estimated annual cost of workplace injuries is $167 billion – which is more than climate change.
Who Is This For? Any employers that need to get ahead of workplace impairment issues. You may not have all the answers, or even know the right questions to ask, but the law requires employers (A) to have someone in your organization trained, (B) to perform an assessment and (C) to document your reasonable suspicion. That is exactly what ATP’s solutions provide, and our mission is to make compliance frictionless.
Since cannabis was legalized in 2021 your organization likely already has this problem. Don’t worry too much on this one - we’ve made compliance fast, easy, and inexpensive. Check out the website, shoot us an email, or give the ATP team a call.
